01 "An Act relating to motor vehicles equipped with data recording or transmitting                                         
02 devices."                                                                                                               
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 45.25 is amended by adding a new section to article 3 to read:                                    
05            Sec. 45.25.330.  Disclosure of data recording or transmitting devices.  A                                
06       manufacturer of a new motor vehicle sold or leased in the state that is equipped with a                           
07       data recording or transmitting device shall disclose the existence of that device in the                          
08       owner's manual for the vehicle.  In this section, "data recording or transmitting                                 
09       devices" means a device that is installed by the manufacturer of the vehicle that                                 
10       records how fast and in which direction a vehicle was going at the time of an accident,                           
11       records where the vehicle travels, records steering or braking performance including                              
12       whether brakes have been applied before an accident, records the driver's seat belt                               
13       status, or has the ability to transmit information about an accident in which the vehicle                         
14       is involved to a central communications system.                                                                   
01    * Sec. 2.  AS 45.45 is amended by adding a new section to read:                                                    
02            Sec. 45.45.230.  Downloading or retrieving information from a data                                         
03       recording or transmission device.  (a)  Information recorded or transmitted by a data                           
04       recording or transmitting device may not be downloaded, accessed, used, or disclosed                              
05       unless                                                                                                            
06                 (1)  the owner of the vehicle consents to the download, access, use, or                                 
07       disclosure;                                                                                                       
08                 (2)  the download, access, use or disclosure is ordered by a court with                                 
09       jurisdiction; or                                                                                                  
10                 (3)  the download, access, use, or disclosure is for the purpose of                                     
11       improving motor vehicle safety and the identity of the owner or driver of the vehicle is                          
12       not disclosed in connection with the information.                                                                 
13            (b)  In this section, "data recording or transmitting device" has the meaning                                
14       given in AS 45.25.330.                                                                                            
15    * Sec. 3.  AS 45.50.471(b) is amended by adding a new paragraph to read:                                           
16                 (47)  violating AS 45.25.330 or AS 45.45.230.
