00                              SENATE BILL NO. 7                                                                          
01 "An Act relating to drivers' licenses and vehicle registration."                                                        
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 28.10.041(d) is amended to read:                                                                  
04            (d)  The department shall refuse to register a vehicle if the applicant                                      
05                 (1)  fails to register the vehicle using the applicant's full first, middle,                        
06       and last name or a business name; or                                                                          
07                 (2)  has an outstanding citation or unpaid fine for a motor vehicle                                 
08       or traffic offense, including a parking offense, under state law or municipal                                 
09       ordinance.                                                                                                    
10    * Sec. 2.  AS 28.15.031(b) is amended to read:                                                                     
11            (b)  The department may not issue an original or duplicate driver's license to,                              
12       or [NOR] renew or reinstate the driver's license of, a person                                                 
13                 (1)  whose license is suspended or revoked, except as otherwise                                         
14       provided in this chapter;                                                                                         
15                 (2)  who                                                                                                
01                      (A)  fails to appear in court for the adjudication of a certain                                
02            vehicle, driver, or traffic offense when the person's appearance is required by                              
03            statute, regulation, or court rule; or                                                                   
04                      (B)  has an outstanding citation or unpaid fine for a motor                                    
05            vehicle or traffic offense, including a parking offense, under state law or                              
06            municipal ordinance;                                                                                     
07                 (3)  who is a [AN] habitual user of alcohol or another drug to the                              
08       [SUCH A] degree that the person is incapable of safely driving a motor vehicle;                                   
09                 (4)  [REPEALED                                                                                          
10                 (5)]  when the department, based upon medical evidence, has                                             
11       determined that, because of the person's physical or mental disability, the person is not                 
12       able to drive a motor vehicle safely;                                                                             
13                 (5) [(6)]  who is unable to understand official traffic control devices as                          
14       displayed in this state or who does not have a fair knowledge of traffic laws and                                 
15       regulations, as demonstrated by an examination;                                                                   
16                 (6) [(7)]  who has knowingly made a false statement in the person's                                 
17       application for a license or has committed fraud in connection with the person's                                  
18       application for, or in obtaining or attempting to obtain, a license, or who has not                               
19       applied under oath on the form provided for the purpose of obtaining or attempting to                             
20       obtain a license or permit; or                                                                                    
21                 (7) [(8)]  who is required under AS 28.20 to furnish proof of financial                             
22       responsibility and who has not done so.
