00 HOUSE BILL NO. 426 01 "An Act relating to medical assistance eligibility and coverage for persons under 21 02 years of age." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 47.07.020(b)(13) is amended to read: 05 (13) persons under 19 years of age who are not covered under (a) of 06 this section and whose household income does not exceed (A) $1,635 a month if the 07 household consists of one person, [;] (B) $2,208 a month if the household consists of 08 two persons, [;] (C) $2,782 a month if the household consists of three persons, [;] (D) 09 $3,355 a month if the household consists of four persons, [;] (E) $3,928 a month if the 10 household consists of five persons, [;] (F) $4,501 a month if the household consists of 11 six persons, [;] (G) $5,074 a month if the household consists of seven persons, [;] (H) 12 $5,647 a month if the household consists of eight persons, [;] (I) $5,647 a month, plus 13 an additional $574 a month for each extra person above eight persons who is in the 14 household if the household consists of nine persons or more; in this paragraph,  01 "household" includes a stepparent who lives with the person who is under 19  02 years of age for more than six cumulative months during the calendar year  03 preceding an application and a person who is included in the household for an  04 eligibility calculation made under another public assistance program; 05  * Sec. 2. AS 47.07.020(h) is amended to read: 06 (h) A person who meets the eligibility requirements of (a) or (b) of this section 07 must be a United States citizen or a lawfully admitted alien under the  08 immigration laws of the United States and a resident of the state [, EXCEPT 09 THAT THE PERSON IS A QUALIFIED ALIEN AS DEFINED IN 8 U.S.C. 1641, IS 10 ELIGIBLE FOR MEDICAL ASSISTANCE UNLESS THE PERSON IS NOT 11 ELIGIBLE UNDER THE LIMITED ELIGIBILITY PROVISION OF 8 U.S.C. 1613]. 12  * Sec. 3. AS 47.07.020 is amended by adding a new subsection to read: 13 (j) A person may not apply for medical assistance coverage for a person under 14 21 years of age unless the person is the parent or legal guardian of the person who 15 needs medical assistance. 16  * Sec. 4. AS 47.07.032 is amended by adding a new subsection to read: 17 (c) Notwithstanding AS 47.07.030, a person under 21 years of age who is 18 admitted to or requires services at a residential psychiatric treatment facility is eligible 19 for medical assistance under this chapter only if the services are not covered by an 20 insurance policy for the person, regardless of the duration of the services.
