01 "An Act relating to registration and operation of neighborhood electric vehicles."                                      
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 28.10.041 is amended by adding a new subsection to read:                                           
04            (e)  The department may not refuse to register a neighborhood electric vehicle                               
05       as a passenger vehicle if that vehicle meets the safety and equipment requirements set                            
06       for passenger vehicles by this state or meets federal motor vehicle safety standards for                          
07       low-speed vehicles.                                                                                               
08    * Sec. 2. AS 28.35 is amended by adding a new section to article 5 to read:                                        
09            Sec. 28.35.261. Operation of neighborhood electric vehicles. (a) The                                       
10       operator of a neighborhood electric vehicle is subject to all the traffic and other laws                          
11       applicable to operators of passenger vehicles.                                                                    
12            (b)  The operator of a neighborhood electric vehicle may not operate that                                    
13       vehicle on a highway that has a maximum speed of more than 35 miles an hour.                                      
14       Notwithstanding this subsection, the operator of a neighborhood electric vehicle may                              
15       cross a highway that has a maximum speed limit of more than 35 miles an hour if the                               
01       crossing is made at the intersection with a highway that is authorized for neighborhood                           
02       electric vehicles.                                                                                                
03    * Sec. 3. AS 28.40.100(a) is amended by adding a new paragraph to read:                                            
04                 (27)  "neighborhood electric vehicle" means an electric motor vehicle                                   
05       that has four wheels and an unladen weight of 1,800 pounds or less, that was                                      
06       manufactured to be capable of propelling itself and achieving a minimum speed of 20                               
07       miles an hour and a maximum speed of 25 miles an hour, and that has not been                                      
08       modified to have a maximum speed greater than 25 miles an hour.
