01 "An Act relating to indecent exposure."                                                                                 
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 11.41.458(a) is amended to read:                                                                  
04            (a)  An offender commits the crime of indecent exposure in the first degree if                               
05       [(1)] the offender violates AS 11.41.460(a), the offense occurs within the                                    
06       observation of a person under 16 years of age, and                                                            
07                 (1)  [; (2)] while committing the act constituting the offense, the                                 
08       offender knowingly masturbates; [AND (3)  THE OFFENSE OCCURS WITHIN THE                                           
09       OBSERVATION OF A PERSON UNDER 16 YEARS OF AGE] or                                                             
10                 (2)  the offender has been previously convicted under                                               
11                      (A)  this section;                                                                             
12                      (B)  AS 11.41.460(a); or                                                                       
13                      (C)  a law or ordinance of this or another jurisdiction with                                   
14            elements similar to a crime listed under (A) or (B) of this paragraph.
