01 "An Act relating to indecent exposure."                                                                                 
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 11.41.458(a) is amended to read:                                                                  
04            (a)  An offender commits the crime of indecent exposure in the first degree if                               
05       [(1)] the offender violates AS 11.41.460(a) and                                                               
06                 (1)  [; (2)] while committing the act constituting the offense, the                                 
07       offender knowingly masturbates and [; AND (3)] the offense occurs within the                                  
08       observation of a person under 16 years of age; or                                                             
09                 (2)  the offender has been previously convicted under this section                                  
10       or AS 11.41.460(a) or a law or ordinance of this or another jurisdiction with                                 
11       elements similar to a crime under this section or AS 11.41.460(a).
