01 "An Act relating to health insurance coverage for gastric bypass surgery; and providing                                 
02 for an effective date."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 21.42 is amended by adding a new section to read:                                                 
05            Sec. 21.42.410.  Coverage for treatment of obesity.  (a)  A health care insurer                            
06       that offers, issues for delivery, delivers, or renews in this state a health care insurance                       
07       plan shall provide coverage under the plan for gastric bypass surgery when the surgery                            
08       is medically necessary for the treatment of obesity.                                                              
09            (b)  The coverage required under this section is subject to standard policy                                  
10       provisions applicable to other covered benefits, including deductible or copayment                                
11       provisions.                                                                                                       
12    * Sec. 2.  This Act takes effect July 1, 2005.
