00 SENATE BILL NO. 227 01 "An Act relating to municipal initiative and referendum elections." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03  * Section 1. AS 29.26.170(a) is amended to read: 04 (a) Unless substantially the same measure is adopted, when a petition seeks an 05 initiative vote, the clerk shall submit the matter to the voters at the next regular 06 election occurring no sooner than 60 [45] days after certification of the petition. [IF 07 NO REGULAR ELECTION OCCURS WITHIN 75 DAYS AFTER THE 08 CERTIFICATION OF A PETITION, THE GOVERNING BODY SHALL HOLD A 09 SPECIAL ELECTION WITHIN 75 DAYS, BUT NOT SOONER THAN 45 DAYS 10 AFTER CERTIFICATION.] 11  * Sec. 2. AS 29.26.170(b) is amended to read: 12 (b) If the governing body adopts substantially the same measure, the petition 13 is void, and the matter initiated may not be placed before the voters. 14  * Sec. 3. AS 29.26.180(a) is amended to read: 15 (a) Unless the ordinance or resolution is repealed, when a petition seeks a 01 referendum vote, the clerk shall submit the matter to the voters at the next election 02 occurring no sooner than 60 [45] days after certification of the petition.
