01 "An Act relating to reports on school and school district performance; and relating to                                  
02 accountability of public schools and school districts; and providing for an effective                                   
03 date."                                                                                                                  
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 14.03.120(d) is amended to read:                                                                  
06            (d)  Annually, before the date set by the district under (e) of this section, each                           
07       public school shall provide, in a public meeting of parents, students, and community                              
08       members, a report on the school's performance and the performance of the school's                                 
09       students. The report shall be prepared on a form prescribed by the department and                                 
10       must include                                                                                                      
11                 (1)  information on accreditation;                                                                      
12                 (2)  results of norm-referenced achievement tests;                                                      
13                 (3)  results of state standards-based assessments in reading, writing, and                              
14       mathematics;                                                                                                      
01                 (4)  a description, including quantitative and qualitative measures, of                                 
02       student, parent, community, and business involvement in student learning;                                         
03                 (5)  a description of the school's attendance, retention, dropout, and                                  
04       graduation rates, including the number and percentage of students who received a                                  
05       diploma under a waiver from the competency examination required under                                             
06       AS 14.03.075(a), as specified by the state board;                                                                 
07                 (6)  the annual percent of enrollment change, regardless of reason, and                                 
08       the annual percent of enrollment change due to student transfers into and out of the                              
09       school district;                                                                                                  
10                 (7)  if Native language education is provided, a summary and                                            
11       evaluation of the curriculum described in AS 14.30.420; [AND]                                                     
12                 (8)  the number and percentage of students in each school who take and                                  
13       who successfully complete an alternative assessment program in reading, English, or                               
14       mathematics; and the number and percentage of pupils in each school who                                           
15       successfully complete the alternative assessment program but who do not reach the                                 
16       state performance standards at the competency exam level in reading, English, or                                  
17       mathematics; a school may not report results under this paragraph unless the school                               
18       complies with the family educational rights and privacy requirements of 34 C.F.R. 99;                         
19                 (9)  the performance designation assigned the school under                                          
20       AS 14.03.123; and                                                                                             
21                 (10)  other information concerning school performance and the                                       
22       performance of the school's students as required by the state board in regulation.                            
23    * Sec. 2.  AS 14.03.120(e) is amended to read:                                                                     
24            (e)  By a date set by the district, each public school in the district shall provide                         
25       the report described in (d) of this section to the district's governing body. Along with                          
26       the report, each public school shall submit a summary of comments made on the report                              
27       by parents, students, and community members. By July 1 of each year, [BEGINNING                                   
28       IN 2000,] each district shall provide to the department a report on the performance of                            
29       each public school and the public school students in the district. The district's report                          
30       must                                                                                                              
31                 (1)  be entitled "School District Report Card to the Public"; and                                       
01                 (2)  include                                                                                            
02                      (A)  copies of the reports and summaries of comments                                               
03            submitted under this section by each public school in the district; [AND]                                    
04                      (B)  a compilation of the material described in (A) of this                                        
05            paragraph by each public school in the district;                                                         
06                      (C)  the designation assigned the district under                                               
07            AS 14.03.123; and                                                                                        
08                      (D)  other information concerning school performance and                                       
09            the performance of the school's students as required by the state board in                               
10            regulation.                                                                                              
11    * Sec. 3.  AS 14.03.123 is repealed and reenacted to read:                                                         
12            Sec.  14.03.123.  School and district accountability.  (a)  By September 1 of                              
13       each year, the department shall assign a performance designation to each public school                            
14       and school district and to the state public school system.  The performance designation                           
15       shall be based on student achievement measures that include the results of the                                    
16       statewide student assessments from the previous school year.                                                      
17            (b)  The department shall inform the governing body of each district of the                                  
18       performance designation assigned under (a) of this section.                                                       
19            (c)  The state board shall adopt regulations implementing this section and                                   
20       providing for the statewide student assessment system and the process of assigning a                              
21       designation under (a) of this section, including                                                                  
22                 (1)  the standards that will be used for assignment of each designation;                                
23                 (2)  a procedure for appealing a designation that may be used by the                                    
24       principal of a public school or by the superintendent of a public school district;                                
25                 (3)  requirements for a school improvement plan and a district                                          
26       improvement plan; and                                                                                             
27                 (4)  additional measures that may be progressively implemented by the                                   
28       commissioner to improve school performance in accordance with this section and with                               
29       federal law; the additional measures may be unique to a certain school or district if                             
30       that school or district receives federal funding that is not available to all schools or                          
31       districts in the state and to the extent necessary to conform to federal law.                                     
01            (d)  In the accountability system for schools and districts required by this                                 
02       section, the department shall                                                                                     
03                 (1)  implement 20 U.S.C. 6301 - 7941 (Elementary and Secondary                                          
04       Education Act of 1965), as amended;                                                                               
05                 (2)  implement criteria and priorities for accountability based on state                                
06       standards, including the use of                                                                                   
07                      (A)  multiple measures of student performance; and                                                 
08                      (B)  measures of student improvement; and                                                          
09                 (3)  to the extent practicable, minimize the administrative burden on                                   
10       districts.                                                                                                        
11            (e)  In this section,                                                                                        
12                 (1)  "district" has the meaning given in AS 14.17.990;                                                  
13                 (2)  "state public school system" means the combination of all public                                   
14       schools, public school districts, and state-operated schools;                                                     
15                 (3)  "statewide student assessment" means the assessment system                                         
16       established under (c) of this section.                                                                            
17    * Sec. 4.  AS 14.03.078 and AS 36.30.850(b)(40) are repealed.                                                      
18    * Sec. 5.  The uncodified law of the State of Alaska is amended by adding a new section to                         
19 read:                                                                                                                   
20       TRANSITION: REGULATIONS.  The Board of Education and Early Development                                            
21 may proceed to adopt regulations to implement the changes made by this Act.  The                                        
22 regulations take effect under AS 44.62 (Administrative Procedure Act), but not before the                               
23 effective date of the statutory change.                                                                                 
24    * Sec. 6.  Section 5 of this Act takes effect immediately under AS 01.10.070(c).                                   
25    * Sec. 7.  Except as provided in sec. 6 of this Act, this Act takes effect July 1, 2004.
