01 "An Act relating to the crime of assault."                                                                              
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 12.55.135(d) is amended to read:                                                                  
04            (d)  A defendant convicted of assault in the fourth degree who knowingly                                     
05       directed the conduct constituting the offense at                                                                  
06                 (1)  a uniformed or otherwise clearly identified peace officer, fire                                
07       fighter, correctional employee, emergency medical technician, paramedic, ambulance                                
08       attendant, or other emergency responder who was engaged in the performance of                                     
09       official duties at the time of the assault shall be sentenced to a minimum term of                                
10       imprisonment of                                                                                                   
11                      (A) [(1)]  60 days if the defendant violated AS 11.41.230(a)(1)                                
12            or (2);                                                                                                      
13                      (B) [(2)]  30 days if the defendant violated AS 11.41.230(a)(3);                           
14                 (2)  an employee of an elementary, junior high, or secondary school                                 
15       who was engaged in the performance of school duties at the time of the assault                                
01       shall be sentenced to a minimum term of imprisonment of                                                       
02                      (A)  60 days if the defendant violated AS 11.41.230(a)(1) or                                   
03            (2);                                                                                                     
04                      (B)  30 days if the defendant violated AS 11.41.230(a)(3);                                     
05                 (3)  a member of the clergy engaged in the performance of religious                                 
06       duties at the time of the assault shall be sentenced to a minimum term of                                     
07       imprisonment of                                                                                               
08                      (A)  60 days if the defendant violated AS 11.41.230(a)(1) or                                   
09            (2);                                                                                                     
10                      (B)  30 days if the defendant violated AS 11.41.230(a)(3).
