00 SENATE JOINT RESOLUTION NO. 40 01 Proposing amendments to the Constitution of the State of Alaska permitting certain bills 02 dealing with appropriations or taxes to take effect only if approved by the voters. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. Article II, sec. 18, Constitution of the State of Alaska, is amended to read: 05 Section 18. Effective Date. (a) Laws passed by the legislature become 06 effective ninety days after enactment. The legislature may, by concurrence of two- 07 thirds of the membership of each house, provide for another effective date. 08  * Sec. 2. Article II, sec. 18, Constitution of the State of Alaska, is amended by adding a 09 new subsection to read: 10 (b) Notwithstanding (a) of this section, a bill with only one appropriation item 11 that appropriates money to the general fund or a bill that only imposes a new tax may 12 include a provision that the bill takes effect only if approved by the voters at the next 13 general or special election held after enactment of the bill. A bill approved by the 14 voters under this subsection takes effect thirty days after the certification of the 15 election returns by the lieutenant governor. 16  * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 01 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 02 State of Alaska, and the election laws of the state.
