01 "An Act prohibiting the imposition of a toll or other fee for use of the Anton Anderson                                 
02 Memorial Tunnel and the Portage Glacier Highway; annulling certain regulations of the                                   
03 Department of Transportation and Public Facilities relating to tolls for use of the Anton                               
04 Anderson Memorial Tunnel and the Portage Glacier Highway; and providing for an                                          
05 effective date."                                                                                                        
06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
07    * Section 1.  AS 19.05.040 is amended by adding a new subsection to read:                                          
08            (b)  Notwithstanding any provision of this chapter or title or any other                                     
09       provision of law, the department may not establish, levy, or collect a toll or other fee                          
10       for use of the Anton Anderson Memorial Tunnel or for use of the Portage Glacier                                   
11       Highway between Portage Creek and the Whittier Ferry Terminal.                                                    
12    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
13 read:                                                                                                                   
01       ANNULMENT OF REGULATIONS PROVIDING FOR A TOLL FOR USE OF                                                          
02 THE ANTON ANDERSON MEMORIAL TUNNEL AND THE PORTAGE GLACIER                                                              
03 HIGHWAY.  The following regulations of the Department of Transportation and Public                                      
04 Facilities, relating to the establishment, levy, and collection of a toll for use of the Anton                          
05 Anderson Memorial Tunnel and the Portage Glacier Highway, are annulled:  17 AAC                                         
06 38.005(a), 17 AAC 38.020, that portion of 17 AAC 38.025(a)(6) referring to motor vehicles                               
07 exempt from tolls, and 17 AAC 38.900(8).                                                                                
08    * Sec. 3.  The uncodified law of the State of Alaska is amended by adding a new section to                         
09 read:                                                                                                                   
10       RETROACTIVITY.  Sections 1 and 2 of this Act are retroactive to March 31, 2001.                                 
11    * Sec. 4.  This Act takes effect immediately under AS 01.10.070(c).
