01 "An Act requiring reductions in payments to individuals under certain benefit                                           
02 programs if appropriations are not sufficient to fully fund the statutorily established                                 
03 levels of payments."                                                                                                    
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 37.07.080 is amended by adding new subsections to read:                                           
06            (i)  If an appropriation made for a benefit program is not sufficient to fully                               
07       fund all statutorily established levels of payments to individuals under that program, a                          
08       state agency                                                                                                      
09                 (1)  shall reduce the amount of payments to eligible individuals on a                                   
10       pro rata basis; and                                                                                               
11                 (2)  may not delay the reductions required under (1) of this subsection                                 
12       based on the possibility that a supplemental appropriation for that program will be                               
13       enacted if the appropriation act that originally funded the program states that payments                          
14       are to be reduced should the funding provided in the act not be sufficient to fully fund                          
01       the program.                                                                                                      
02            (j)  The provisions of (i) of this section do not apply to payment under                                     
03       AS 23.30 (Workers' Compensation Act), AS 23.35.060 - 23.35.100, AS 25.23.190 -                                    
04       25.23.240, loan programs, state employee retirement benefit programs, or benefit                                  
05       programs for which other provisions of law address underfunding.                                                  
06    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
07 read:                                                                                                                   
08       SEVERABILITY.  Under AS 01.10.030, if any provision of this Act or the application                                
09 of it to any person or circumstance is held invalid, the remainder of this Act and the                                  
10 application to other persons or circumstances are not affected.
