01 "An Act requiring reductions in payments to individuals under certain benefit                                           
02 programs if appropriations are not sufficient to fully fund the statutorily established                                 
03 levels of payments."                                                                                                    
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 37.07.080(d) is amended to read:                                                                  
06            (d)  A state agency                                                                                          
07                 (1)  shall, if an appropriation made for a benefit program is not                                   
08       sufficient to fully fund all statutorily established levels of payments to individuals                        
09       under that program, reduce the amount of payments to eligible individuals on a                                
10       pro rata basis; in making the pro rata reductions required by this paragraph, the                             
11       agency may not consider any potential supplemental appropriation for that                                     
12       program until the appropriation has been enacted; this paragraph does not apply                               
13       to payments under AS 25.23.190 - 25.23.240, loan programs, state employee                                     
14       retirement benefit programs, or programs for which other provisions of law                                    
01       address underfunding; and                                                                                     
02                 (2)  may not increase the salaries of its employees, employ additional                              
03       employees, or expend money or incur obligations except in accordance with law and                                 
04       properly approved operations plan.
