00 CS FOR SENATE BILL NO. 175(L&C) 01 "An Act providing municipalities with the authority to protest the issuance and renewal 02 of charitable gaming permits and licenses based upon violations of municipal ordinances 03 and requiring the Department of Revenue to deny the license or permit until the 04 violation is remedied." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06  * Section 1. AS 05.15.030(a) is amended to read: 07 (a) At the time of filing an application for a permit or license under this 08 chapter, the applicant shall notify the city or borough nearest to the location of the 09 proposed activity of the application. A municipality [A LOCAL GOVERNMENT 10 UNIT] may, after holding a hearing at which the applicant is afforded the  11 opportunity to make a defense, protest [THE CONDUCT OF THE ACTIVITY IN 12 ITS JURISDICTION] by resolution [STATING] the issuance of a permit or license  01 based on the violation of a municipality's ordinances; the department shall  02 consider the protest and shall deny the permit or license until notified by the  03 municipality that the violation has been remedied [REASONS FOR THE 04 PROTEST FILED WITH THE DEPARTMENT; PROTESTS ARE LIMITED TO 05 THE LACK OF QUALIFICATIONS PRESCRIBED BY THIS CHAPTER. THIS 06 RESOLUTION IS ONLY A RECOMMENDATION BY THE LOCAL 07 GOVERNMENT THAT MAY BE CONSIDERED BY THE DEPARTMENT IN 08 DETERMINING WHETHER TO ISSUE OR REFUSE TO ISSUE A PERMIT OR 09 LICENSE].
