01 "An Act relating to construction of highways by the Department of Transportation and                                    
02 Public Facilities and to contracts for the construction of highways."                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 19.10.170(a) is amended to read:                                                                  
05            (a)  Except as provided in AS 44.33.300, it is the general policy of the state to                            
06       require the construction of all highways under bid contract in accordance with                                    
07       AS 36.30 (State Procurement Code).  However, subject to the provisions of (b) of this                             
08       section, the department may perform the work notwithstanding any other                                        
09       provisions of law                                                                                             
10                 (1)  when the estimated cost of a construction project is less than                                 
11       $100,000; or                                                                                                  
12                 (2)  when                                                                                           
13                      (A)  it appears to be in the best interests of the state; and                              
14                      (B)  the estimated cost of a construction project is                                           
01            $1,000,000 or less, or no responsive and responsible bidder submits a bid [,                             
02            THE    DEPARTMENT     MAY     PERFORM    THE    WORK                                                         
03            NOTWITHSTANDING ANY OTHER PROVISIONS OF LAW].                                                                
04    * Sec. 2.  AS 19.10.170 is amended by adding a new subsection to read:                                             
05            (d)  This section does not in any way prohibit or restrict the department from                               
06       entering into contracts with federal agencies or municipalities relating to the                                   
07       construction of highways.
