00                        HOUSE JOINT RESOLUTION NO. 4                                                                     
01 Proposing amendments to the Constitution of the State of Alaska authorizing a priority                                  
02 for subsistence users of replenishable natural resources; and providing for an effective                                
03 date.                                                                                                                   
04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
05    * Section 1.  Article VIII, Constitution of the State of Alaska, is amended by adding a new                        
06 section to read:                                                                                                        
07            Section 19.  Subsistence.  The legislature may, consistent with the sustained                              
08       yield principle, provide a priority for subsistence users in the taking of fish and                               
09       wildlife and other replenishable natural resources based on place of residence,                                   
10       dependence on replenishable natural resources for subsistence uses, or customary and                              
11       traditional use of replenishable natural resources for subsistence uses.                                          
12    * Sec. 2.  Article XV, Constitution of the State of Alaska, is amended by adding a new                             
13 section to read:                                                                                                        
14            Section 30.  Effective Date of Subsistence Amendment.  Section 19 of                                       
15       Article VIII, regarding a priority for subsistence users of replenishable natural                                 
01       resources, takes effect immediately upon certification of the election returns by the                             
02       lieutenant governor.                                                                                              
03    * Sec. 3.  The amendments proposed by this resolution shall be placed before the voters of                         
04 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the                        
05 State of Alaska, and the election laws of the state.
