00 HOUSE BILL NO. 452 01 "An Act relating to consolidation of school districts; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.12 is amended by adding a new section to article 1 to read: 05 Sec. 14.12.027. Consolidation of school districts. (a) Notwithstanding any 06 other provision of law, if a school district has less than 100 students in average daily 07 membership for two consecutive school years, the department shall require the school 08 district to join with another school district in that area of the state and form a new 09 consolidated school district. This subsection does not apply to a city or borough 10 school district if by application of this subsection the city or borough school district 11 would be consolidated with a regional educational attendance area. 12 (b) A term of a member of a school board of a school district that is 13 consolidated under (a) of this section is not affected by this section until a new school 14 board is established. 01 (c) A contract, right, liability, obligation, record, equipment, or other property 02 of a school district consolidated under this section shall be transferred to the 03 consolidated school district. 04 (d) In this section, 05 (1) "average daily membership" has the meaning given in 06 AS 14.17.990; 07 (2) "school district" means a city or borough school district or a 08 regional educational attendance area. 09 * Sec. 2. This Act takes effect July 1, 2002.
