00 HOUSE BILL NO. 286 01 "An Act allowing a person to hold more than one commercial fishing entry permit for a 02 fishery; relating to the power of the Board of Fisheries to establish fishing periods and 03 areas for subgroups of commercial fishing permits and commercial fishing permit 04 holders and to establish limits on the amount of fishing gear that may be used by certain 05 commercial fishing permit holders; and providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07  * Section 1. AS 16.05.251 is amended by adding a new subsection to read: 08 (i) The Board of Fisheries, after consultation with the Alaska Commercial 09 Fisheries Entry Commission, may 10 (1) restrict distinct, identified subgroups of commercial fishing permits 11 or permit holders in a fishery to certain fishing periods or fishing areas within the 12 fishery; the board shall provide, to the extent practicable, reasonable fishing 13 opportunities for subgroups of permits or permit holders in the fishery; 01 (2) establish the amount of gear that a commercial fishing entry permit 02 holder who holds more than one entry permit for a fishery may employ in the fishery 03 under each additional entry permit that the permit holder holds for the fishery. 04  * Sec. 2. AS 16.43.140(c) is amended to read: 05 (c) A person may hold more than one interim-use or entry permit issued or 06 transferred under this chapter only for the following purposes: 07 (1) fishing more than one type of gear; 08 (2) fishing in more than one administrative area; 09 (3) harvesting particular species for which separate interim-use or 10 entry permits are issued; 11 (4) if authorized by regulations of the commission, fishing an entire 12 unit of gear in a fishery in which the commission has issued entry permits for less than 13 a unit of gear under AS 16.43.270(d); under this paragraph, a person may not hold 14 more than two entry permits for a fishery; however, the person may not 15 (A) fish more than one unit of gear in the fishery; or 16 (B) acquire a second entry permit for the fishery after the 17 person has acquired an entry permit that authorizes the use of an entire unit of 18 gear in the fishery;  19 (5) fishing an additional unit of gear or an additional increment of  20 a unit of gear in a fishery if the Board of Fisheries authorizes persons to fish  21 more than one unit of gear in a fishery;  22 (6) fishing during fishing periods for more than one subgroup of  23 entry permits or entry permit holders for a fishery if the Board of Fisheries has  24 established separate fishing periods in a fishery for distinct, identified subgroups  25 of entry permits or entry permit holders for the fishery;  26 (7) fishing in open areas for more than one subgroup of entry  27 permits or entry permit holders for a fishery if the Board of Fisheries has  28 established separate fishing areas in a fishery for distinct, identified subgroups of  29 entry permits or entry permit holders for the fishery;  30 (8) if authorized by regulations of the commission, reducing the  31 number of persons participating in a fishery by allowing a person to acquire and  01 hold two or more entry permits for the fishery. 02  * Sec. 3. AS 16.43.150(a) is amended to read: 03 (a) Except as may be otherwise provided under AS 16.05.251(i) or 04 AS 16.43.270(d), an entry permit authorizes the permit holder [PERMITTEE] to 05 operate a unit of gear within a specified fishery. 06  * Sec. 4. This Act takes effect January 1, 2003.
