01 "An Act relating to employment of certain minors in agriculture."                                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 23.10.332 is amended to read:                                                                     
04            Sec. 23.10.332.  Authorization for children under 17 to work.  (a)  Except                               
05       for employment exempted under AS 23.10.330 and other employment specifically                                      
06       exempted by regulations adopted by the department, a minor under 17 years of age                                  
07       may not be employed or allowed to work without the written authorization of the                                   
08       commissioner unless authorized under AS 23.10.360 or under (c) of this section.                               
09            (b)  The department shall adopt regulations necessary to implement this                                  
10       section.                                                                                                          
11    * Sec. 2.  AS 23.10.332 is amended by adding a new subsection to read:                                           
12            (c)  A minor who is at least 14 years of age may be employed in agriculture                                  
13       without the written authorization of the commissioner under (a) of this section if                                
14                 (1)  the employer receives written consent from                                                         
15                      (A)  both the minor's parents or legal guardians;                                                  
01                      (B)  one of the minor's parents if the minor only has one parent                                   
02            living or if a court has awarded custody of the minor to one parent; or                                      
03                      (C)  one legal guardian if only one legal guardian has been                                        
04            appointed; or                                                                                                
05                 (2)  the minor performs the work in the physical presence of one of the                                 
06       minor's parents or legal guardians; if legal custody of the minor has been set under a                            
07       court order, the minor must perform the work in the presence of a person granted legal                            
08       custody of the minor to satisfy the requirement of this paragraph.
