00 HOUSE BILL NO. 68 01 "An Act relating to civil liability for transporting an intoxicated person; and providing 02 for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 09.65 is amended by adding a new section to read: 05 Sec. 09.65.280. Damages resulting from transportation of an intoxicated  06 person. (a) An intoxicated person who is being transported from licensed premises in 07 a taxicab and who suffers personal injury or death during the transport may not 08 recover civil damages from the owner of the licensed premises, an employee of the 09 owner of the licensed premises, or the driver or owner of the taxicab if the owner, 10 employee, or driver is acting in good faith. In this subsection, "licensed premises" has 11 the meaning given in AS 04.21.080(b). 12 (b) This section does not preclude liability for civil damages as a result of 13 gross negligence or reckless or intentional misconduct. 14  * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 01 read: 02 APPLICABILITY. This Act applies to a civil action that accrues on or after 03 the effective date of this Act. 04  * Sec. 3. This Act takes effect July 1, 2001.
