00 CS FOR SENATE BILL NO. 290(FIN) am 01 "An Act imposing limits on state funding for transportation of school students; 02 requiring that a minimum amount expended by school districts for instruction 03 does not include expenditures for school administration, assistant principals, or 04 other assistants employed to generally supervise administrative operations of a 05 school, and defining 'school administration'; providing that, for purposes of 06 public school funding, a community with an average daily membership of at 07 least 101 but not more than 450 shall be counted as one elementary and one 08 secondary school and, in a community with an average daily membership of 09 greater than 450, each facility that is administered as a separate school shall 10 be counted as one school, except for certain alternative schools; and providing 11 for an effective date." 12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 13 * Section 1. AS 14.09.010(b) is amended to read: 14  (b)  Except as otherwise provided in (d) of this section, a [A] 01 school district that enters into a contract described under (a)(1) of this section 02 shall be reimbursed for 03  (1) at least 90 percent of the cost of operating the student 04 transportation system if the transportation is provided by the school district; 05 and 06  (2) 100 percent of the cost of operating the student 07 transportation system when the transportation is provided under a contract with 08 the school district. 09 * Sec. 2. AS 14.09.010(d) is repealed and reenacted to read: 10  (d) Transportation costs eligible for reimbursement under this section 11 are subject to the following adjustments: 12  (1) transportation costs may not exceed the amount received 13 by the school district for student transportation reimbursement in state fiscal 14 year 2001; 15  (2) costs resulting from new school facilities, an increase in 16 enrollment, or costs incurred to meet a requirement imposed by state or 17 federal law are exempt from the limit imposed under (d) of this subsection; 18  (3) the sum calculated under (1) of this subsection shall be 19 increased for each state fiscal year following state fiscal year 2001 by the 20 lesser of the following: 21  (A) four percent; or 22  (B) any increases in the Consumer Price Index for all 23 urban consumers for the Anchorage metropolitan area compiled by the 24 Bureau of Labor Statistics, United States Department of Labor; the 25 index for January of 2001 is the reference base index; and 26  (4) only 50 percent of those costs reimbursable under this 27 section that are in excess of the sum calculated under (1) - (3) of this 28 subsection shall be reimbursed to a school district. 29 * Sec. 3. AS 14.17.520(f) is amended to read: 30  (f) In this section, 31   (1) "instructional component"  means  [INCLUDES] expenditures 01 for teachers and [FOR] pupil support services , but does not include 02 expenditures for school administration or for assistant principals or other 03 assistants employed to generally supervise administrative operations of a 04 school; 05  (2) "school administration" means expenditures related to 06 managing a school, including expenditures for supplies, materials, and 07 travel . 08 * Sec. 4. AS 14.17.905 is amended to read: 09  Sec. 14.17.905. Facilities constituting a school. For purposes of this 10 chapter, the determination of the number of schools in a district is subject 11 to the following: 12  (1) a community with an ADM of at least 10, but not more 13 than 100, shall be counted as one school; 14  (2) a community with an ADM of at least 101, but not more 15 than  450  [750], shall be counted as 16  (A) one elementary school, which includes those students 17 in grades kindergarten through  six  [6]; and 18  (B) one secondary school, which includes students in 19 grades  seven  [7] through 12; 20  (3) in a community with an ADM of greater than  450  [750], 21 each facility that is administered as a separate school shall be counted as 22 one school, except that each alternative school with an ADM of less than 23 200 shall be counted as a part of the school in the district with the highest 24 ADM. 25 * Sec. 5. Sections 3 and 4 of this Act take effect July 1, 2000. 26 * Sec. 6. Sections 1 and 2 of this Act take effect July 1, 2001.
