00 CS FOR SENATE BILL NO. 252(RES) 01 "An Act relating to surveying, mapping, and records on the automated state land 02 record system concerning rights-of-way acquired under former 43 U.S.C. 932, 03 requiring the state to record each right-of-way acquired under former 43 U.S.C. 04 932 within one year of the date the right-of-way is reported by the Department 05 of Natural Resources to the legislature or is listed by the legislature; and 06 suspending the recording requirements, before survey, for certain rights-of-way on 07 parcels less than 41 acres." 08 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. AS 19.30.400 is amended by adding a new subsection to read: 10  (e) The Department of Natural Resources shall create and maintain a record 11 on the automated state land records system of rights-of-way that have been either 12 reported to the legislature under (b) of this section or listed in (d) of this section. 13 * Sec. 2. AS 19.30 is amended by adding a new section to read: 14  Sec. 19.30.415. Survey, mapping, and recording requirements for rights-of- 01 way. (a) The state may 02  (1) survey a right-of-way acquired under former 43 U.S.C. 932; and 03  (2) mark a right-of-way acquired under former 43 U.S.C. 932 to make 04 the route of the right-of-way visually evident. 05  (b) The state shall record a right-of-way acquired under former 43 U.S.C. 932 06 within one year of the date the right-of-way is (1) reported to the legislature under 07 AS 19.30.400(b); or (2) listed in AS 19.30.400(d). In completing the recording, the 08 department and the recorder may not require the right-of-way to satisfy the 09 requirements of AS 40.17.030. 10  (c) Notwithstanding (b) of this section, if requested by a municipality with 11 platting authority, before survey, the Department of Natural Resources does not have 12 to record portions of a right-of-way acquired under former 43 U.S.C. 932 on parcels 13 of less than 41 acres within the municipality.
