00 HOUSE BILL NO. 3002 01 "An Act relating to the compensation of certain public officials, officers, and 02 employees not covered by collective bargaining agreements; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 24.10.100 is amended by adding new subsections to read: 06  (b) Effective July 1, 2001, the monthly salary amount set out in (a) of this 07 section is increased by two percent. 08  (c) Effective July 1, 2002, the monthly salary amount set out in (a) of this 09 section, as increased under (b) of this section, is increased by three percent. 10 * Sec. 2. AS 39.20.010 is amended by adding new subsections to read: 11  (b) Effective July 1, 2001, the amount set out in (a) of this section is increased 12 by two percent. 13  (c) Effective July 1, 2002, the amount set out in (a) of this section, as 14 increased under (b) of this section, is increased by three percent. 01 * Sec. 3. AS 39.20.030 is amended by adding new subsections to read: 02  (b) Effective July 1, 2001, the amount set out in (a) of this section is increased 03 by two percent. 04  (c) Effective July 1, 2002, the amount set out in (a) of this section, as 05 increased under (b) of this section, is increased by three percent. 06 * Sec. 4. AS 39.27.011(e) is repealed and reenacted to read: 10  (e) Effective July 1, 2001, the amounts set out in the salary schedule contained 11 in (a) of this section are increased by two percent. 12 * Sec. 6. AS 39.27.011(f) is repealed and reenacted to read: 13  (f) Effective July 1, 2002, the amounts set out in the salary schedule contained 14 in (a) of this section, as increased under (e) of this section, are increased by three 15 percent. 16 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section 17 to read: 18 LUMP SUM PAYMENT FOR EMPLOYEES OF THE LEGISLATIVE BRANCH 19 AND CERTAIN OFFICERS AND EMPLOYEES OF THE EXECUTIVE BRANCH. (a) 20 Subject to an appropriation for fiscal year 2001 for that purpose, and except as provided in 21 (b) of this section, classified and partially exempt officers and employees in the executive 22 branch of the state government who are not members of a collective bargaining unit 23 established under the authority of AS 23.40.070 - 23.40.260 (Public Employment Relations 24 Act), and employees of the legislature under AS 24.10 and AS 24.20, employed and in pay 25 status on July 1, 2000, are entitled to receive a lump sum payment of $1,200, reduced by $50 26 for each pay period that the officer or employee was not in pay status in fiscal year 2000. 27 The lump sum will also be reduced by amounts necessary to pay mandatory employee and 28 employer deductions. 29 (b) Notwithstanding the requirements of (a) of this section, employees of the 30 legislature who would otherwise be entitled to payment under (a) of this section but who were 31 not employed or in pay status on July 1, 2000, because their employment was limited to the 01 legislative session, are entitled to receive the prorated lump sum payment provided in (a) of 02 this section. 03 * Sec. 8. The uncodified law of the State of Alaska is amended by adding a new section 04 to read: 05 LUMP SUM PAYMENT FOR CERTAIN ELECTED AND APPOINTED OFFICIALS, 06 MAGISTRATES, AND JUDICIAL OFFICERS. Justices of the supreme court, judges of the 07 court of appeals and the superior and district courts, magistrates, legislators, the governor, and 08 the lieutenant governor are entitled to receive the lump sum payment provided for in sec. 7 09 of this Act, subject to the conditions set out in that section. 10 * Sec. 9. The uncodified law of the State of Alaska is amended by adding a new section 11 to read: 12 SALARY ADJUSTMENTS AND LUMP SUM PAYMENT FOR CERTAIN EXEMPT 13 OFFICERS AND EMPLOYEES OF THE EXECUTIVE BRANCH. Public officers and 14 permanent and temporary employees in the executive branch of the state government, other 15 than the governor and lieutenant governor, who are in the exempt service under AS 39.25, are 16 not members of a collective bargaining unit established under AS 23.40.070 - 23.40.260 17 (Public Employment Relations Act ), and are not otherwise covered by AS 39.27.011(a), are 18 entitled to receive 19 (1) salary adjustments comparable to those received by classified and partially 20 exempt employees of the executive branch under AS 39.27.011(e) and (f), as repealed and 21 reenacted by secs. 5 and 6 of this Act; and 22 (2) the lump sum payment provided for in sec. 7 of this Act, subject to the 23 conditions set out in that section. 24 * Sec. 10. The uncodified law of the State of Alaska is amended by adding a new section 25 to read: 26 SALARY ADJUSTMENTS AND LUMP SUM PAYMENT FOR CERTAIN 27 EMPLOYEES OF THE JUDICIAL BRANCH. (a) Permanent and temporary employees in 28 the judicial branch of the state government, other than magistrates and judicial officers, who 29 are not members of a collective bargaining unit established under AS 23.40.070 - 23.40.260 30 (Public Employment Relations Act) are entitled to receive 31 (1) salary adjustments comparable to those received by classified and partially 01 exempt employees of the executive branch under AS 39.27.011(e) and (f), as repealed and 02 reenacted by secs. 5 and 6 of this Act; and 03 (2) the lump sum payment provided for in sec. 7 of this Act, subject to the 04 conditions set out in that section. 05 (b) Justices of the supreme court, judges of the court of appeals and the superior and 06 district courts, and magistrates are entitled to receive salary adjustments provided for in secs. 07 5 and 6 of this Act, in accordance with AS 22.05.140(d), AS 22.07.090(c), AS 22.10.190(d), 08 and AS 22.15.220(b) and (e). 09 * Sec. 11. The uncodified law of the State of Alaska is amended by adding a new section 10 to read: 11 SALARY INCREASES FOR CERTAIN EMPLOYEES OF THE UNIVERSITY OF 12 ALASKA. The employees of the University of Alaska who are not members of a collective 13 bargaining unit are entitled to receive salary increases in accordance with the compensation 14 policy of the Board of Regents of the University of Alaska. 15 * Sec. 12. AS 39.27.011(g) is repealed. 16 * Sec. 13. This Act takes effect July 1, 2000.
