00 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 381 01 "An Act relating to peace officer powers exercised at the direction of the 02 Alcoholic Beverage Control Board; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new 05 section to read: 06 FINDINGS AND INTENT. (a) The legislature finds that 07 (1) proper enforcement of laws applicable to individuals who are licensed to 08 sell alcoholic beverages is critical to the health and safety of all Alaskans; 09 (2) Alcoholic Beverage Control Board enforcement powers must be carried out 10 by peace officers with appropriate investigative powers and training; 11 (3) the Alaska state troopers are capable of investigating and enforcing the 12 alcohol laws of the state. 13 (b) It is the intent of the legislature that, when employees of the Alcoholic Beverage 14 Control Board are not granted peace officer powers to enforce laws relating to alcoholic 01 beverages, the employees of the Department of Public Safety enforce statutes relating to 02 alcohol. 03 * Sec. 2. AS 04.06.110 is amended by adding a new subsection to read: 04  (b) When the board has requested that peace officer powers be granted to the 05 employees of the board and the commissioner of public safety has refused to concur, 06 the board may request that the commissioner of public safety assign one or more 07 employees with full peace officer powers to work at the direction and control of the 08 board, and the commissioner shall grant the request. Notwithstanding (a) of this 09 section, assigned employees shall retain full peace officer powers, including the power 10 to investigate and prosecute any violation of law and generally to protect the public. 11 * Sec. 3. This Act takes effect July 1, 2000.
