00 CS FOR HOUSE BILL NO. 158(L&C) 01 "An Act relating to the annual report of the director of the division of insurance 02 and to notice of cancellation of personal insurance." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 21.06.110 is amended to read: 05  Sec. 21.06.110. Director's annual report. As early in each calendar year as 06 is reasonably possible, the director shall prepare and deliver an annual report to the 07 commissioner, who shall notify the legislature that the report is available, showing, 08 with respect to the preceding calendar year, 09  (1) a list of the authorized insurers transacting insurance in this state, 10 with a summary of their financial statement as the director considers appropriate; 11  (2) the name of each insurer whose certificate of authority was 12 surrendered, suspended, or revoked during the year and the cause of surrender, 13 suspension, or revocation; 14  (3) the name of each insurer authorized to do business in this state 01 against which delinquency or similar proceedings were instituted and, if against an 02 insurer domiciled in this state, a concise statement of the facts with respect to each 03 proceeding and its present status; 04  (4) a statement in regard to examination of rating organizations, 05 advisory organizations, joint underwriters, and joint reinsurers as required by 06 AS 21.39.120; 07  (5) the receipt and expenses of the division for the year; 08  (6) recommendations of the director as to amendments or 09 supplementation of laws affecting insurance or the office of director; 10  (7) statistical information regarding health insurance, including the 11 number of individual and group policies sold or terminated in the state; this 12 paragraph does not authorize the director to require an insurer to release 13 proprietary information; and 14  (8)  other pertinent information and matters the director considers 15 proper. 16 * Sec. 2. AS 21.36.220(a) is repealed and reenacted to read: 17  (a) An insurer may not exercise its right to cancel a personal insurance policy 18 unless, for a named insured who is 19  (1) less than 70 years of age, a written notice of cancellation is mailed 20 to the named insured as required by AS 21.36.260 at least 30 days before the effective 21 date of cancellation; however, if cancellation is for nonpayment of premium, the notice 22 shall be mailed to the named insured as required by AS 21.36.260 at least 20 days 23 before the effective date of cancellation, and, if cancellation is for a reason described 24 in AS 21.36.210(a)(2), (f)(2), or (f)(3), the notice shall be mailed to the named insured 25 as required by AS 21.36.260 at least 10 days before the effective date of cancellation; 26 and 27  (2) 70 years of age or older, a written notice of cancellation is mailed 28 to the named insured and, if the named insured has made a written request to the 29 insurer, to the named insured's designee as required by AS 21.36.260 at least 30 days 30 before the effective date of cancellation; however, if cancellation is for nonpayment 31 of premium, the notice shall be mailed to the named insured and, if the named insured 01 has made a written request to the insurer, to the named insured's designee as required 02 by AS 21.36.260 at least 20 days before the effective date of cancellation, and, if 03 cancellation is for a reason described in AS 21.36.210(a)(2), (f)(2), or (f)(3), the notice 04 shall be mailed to the named insured and, if the named insured has made a written 05 request to the insurer, to the named insured's designee as required by AS 21.36.260 at 06 least 10 days before the effective date of cancellation; an insurer who provides a 07 personal insurance policy to an insured who is 70 years of age or older shall annually 08 give written notice to the insured of the insured's right to have a designee receive 09 notice as provided in this paragraph.
