01 "An Act relating to the authority of the Department of Natural Resources to                                             
02 issue citations for certain skiing violations; relating to establishing a bail schedule                                 
03 for certain skiing violations and to procedures for issuing a citation for a skiing                                     
04 violation."                                                                                                             
05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
06    * Section 1.  AS 05.45.100(h) is amended to read:                                                                  
07  (h)  A person who violates a provision of (c) or (g) of this section is guilty of                                     
08 a violation as defined in AS 11.81.900.  The commissioner of natural resources, a                                       
09 person designated by the ski area operator who is authorized by the commissioner, or                                    
10 an employee of the Department of Natural Resources authorized by the commissioner                                       
11 may issue a citation in accordance with the provisions of AS 41.21.960 to a person                                      
12 who violates (c) or (g) of this section within a ski area [OVER WHICH THE STATE                                         
13 HAS JURISDICTION].                                                                                                      
14    * Sec. 2.  AS 05.45.100 is amended by adding a new subsection to read:                                             
01  (i)  The supreme court shall establish by rule or order a schedule of bail                                            
02 amounts that may be forfeited without a court appearance for a violation of (c) or (g)                                  
03 of this section.                                                                                                        
04    * Sec. 3.  AS 12.25.190(c) is amended to read:                                                                     
05  (c)  The person cited for the crime shall give a written promise to appear in                                         
06 court by signing at least one copy of the written citation prepared by the peace officer ,                            
07 and the officer shall deliver a copy of the citation to the person.  The written promise                                
08 requirement of this subsection does not apply to motor vehicle and traffic citations for                                
09 which a bail or fine schedule has been established under AS 28.05.151, fish and game                                    
10 citations for which a bail schedule has been established under AS 16.05.165, citations                                  
11 issued under AS 04.21.065,  citations for skiing violations issued under                                               
12 AS 05.45.100,  citations issued under AS 18.35.341, citations issued in state park and                                 
13 recreational facilities under AS 41.21.960, or littering citations issued under                                         
14 AS 46.06.080.
