01 "An Act relating to the exemption from the requirement for payment of minimum                                           
02 wage and overtime compensation for certain volunteers of nonprofit organizations;                                       
03 exempting individuals who provide ski patrol services on a voluntary basis from                                         
04 the requirement for payment of minimum wage and overtime compensation; and                                              
05 providing for an effective date."                                                                                       
06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
07    * Section 1.  AS 23.10.055(6) is amended to read:                                                                  
08   (6)  an individual engaged in the  nonprofit  activities of a nonprofit                                            
09 religious, charitable, cemetery, or educational organization  or other nonprofit                                       
10 organization  where the employer-employee relationship does not, in fact, exist, and                                   
11 where services rendered to the organization are on a voluntary basis  and are related                                  
12 only to the organization's nonprofit activities ;                                                                      
13    * Sec. 2.  AS 23.10.055(16) is amended to read:                                                                    
14   (16)  an individual who                                                                                              
01    (A)   provides emergency medical services only on a voluntary                                                    
02 basis ;                                                                                                                
03   (B)   [OR AN INDIVIDUAL WHO] serves with a full-time fire                                                          
04 department only on a voluntary basis ; or                                                                              
05   (C)  provides ski patrol services on a voluntary basis .                                                           
06    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
