00 CS FOR HOUSE BILL NO. 52(FIN) am(efd fld) 01 "An Act making appropriations for salary and benefit adjustments and to fund 02 certain collective bargaining agreements." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. COLLECTIVE BARGAINING AGREEMENTS; SALARY AND BENEFIT 05 ADJUSTMENTS. (a) The sum of $20,335,700 is appropriated from other funds to the Office 06 of the Governor, office of management and budget, for the fiscal year ending June 30, 2001, 07 to implement the monetary terms of the following collective bargaining agreements: 08 COLLECTIVE BARGAINING AGREEMENT 09 (1) Alaska Public Employees Association, for the Supervisory Unit; 10 (2) Alaska State Employees Association, for the General Government Unit; 11 (3) Alaska Vocational Technical Center Teachers Association representing 12 teachers at the Alaska Vocational Technical Center; 13 (4) Alyeska Correspondence School Education Association, representing 14 teachers at the Alyeska Central School; 01 (5) Confidential Employees Association; 02 (6) Inlandboatmen's Union of the Pacific, representing the unlicensed marine 03 unit; 04 (7) International Organization of Masters, Mates, and Pilots, Pacific Maritime 05 Region, for the Masters, Mates, and Pilots Unit; 06 (8) Marine Engineers Beneficial Association, representing licensed engineers 07 employed by the Alaska marine highway system; 08 (9) Public Employees Local 71, for the Labor, Trades and Crafts Unit; 09 (10) Public Safety Employees Association, for the Correctional Officers Unit; 10 (11) Public Safety Employees Association, representing state troopers and other 11 commissioned law enforcement personnel; and 12 (12) Teachers' Education Association of Mt. Edgecumbe. 13 (b) The following amounts are appropriated to the Alaska Court System, the 14 legislature, and the Office of the Governor, office of management and budget, for the fiscal 15 year ending June 30, 2001, from other funds in the amounts listed for salary and benefit 16 adjustments for employees of those agencies who are not members of a collective bargaining 17 unit: 18 AGENCY APPROPRIATION AMOUNT 19 Alaska Court System $1,154,500 20 Legislature 634,000 21 Executive Branch 2,611,600 22 (c) LEGISLATIVE INTENT. It is the intent of the legislature that part of the 23 appropriation in (b) of this section is to provide lump sum payments of up to $1,200, prorated 24 at $50 for each pay period that the employee was in pay status in fiscal year 2000, but 25 reduced by amounts necessary to pay mandatory employee and employer deductions, for 26 (1) classified and partially exempt employees in the executive branch of the 27 state government who are not members of a collective bargaining unit established under the 28 authority of AS 23.40.070 - 23.40.260 (Public Employment Relations Act), employed and in 29 pay status on July 1, 2000; 30 (2) the governor and the lieutenant governor, employed and in pay status on 31 July 1, 2000; 01 (3) permanent and temporary employees in the executive branch of the state 02 government, other than the governor and lieutenant governor, who are in the exempt service 03 under AS 39.25, not members of a collective bargaining unit established under AS 23.40.070 - 04 23.40.260 (Public Employment Relations Act), and employed and in pay status on July 1, 05 2000; 06 (4) employees of the legislature under AS 24.10 and AS 24.20, employed and 07 in pay status on July 1, 2000, excluding members of the legislature; 08 (5) employees of the legislature who would otherwise be entitled to payment 09 under (4) of this subsection but who are not employed or in pay status on July 1, 2000, 10 because their employment was limited to the legislative session; 11 (6) justices of the state supreme court, judges of the state court of appeals, 12 state superior court judges, state district court judges, and state magistrates, employed and in 13 pay status on July 1, 2000; 14 (7) permanent and temporary employees in the judicial branch of the state 15 government, other than magistrates and judicial officers, who are not members of a collective 16 bargaining unit established under AS 23.40.070 - 23.40.260 (Public Employment Relations 17 Act), and are employed and in pay status on July 1, 2000. 18 (d) The sum of $6,426,300 is appropriated from other funds to the University of 19 Alaska for the fiscal year ending June 30, 2001, for salary and benefit adjustments for 20 university employees who are not members of a collective bargaining unit and to implement 21 the monetary terms of the collective bargaining agreements of the 22 (1) University of Alaska Classified Employees Association; 23 (2) Alaska Community Colleges' Federation of Teachers; 24 (3) United Academics; and 25 (4) United Academics - Adjuncts. 26  * Sec. 2. FUNDING SOURCES; ALASKA MARINE HIGHWAY SYSTEM; EFFECTS 27 OF NONRATIFICATION. UNALLOCATED REDUCTIONS. (a) Except for the appropriations identified 04 in (b) of this section, the amounts appropriated from the general fund for the fiscal year 2001 05 operating expenses of the executive branch as contained in the Conference Committee 06 Substitute for HB 312 and enacted into law are reduced by 1.125 percent. This reduction is 07 an unallocated reduction of the amounts appropriated from the general fund, and the Office 08 of the Governor, office of management and budget, shall allocate the reduction among the 09 appropriations for the fiscal year 2001 operating expenses of the agencies of the executive 10 branch. 11 (b) The following appropriations contained in Conference Committee Substitute for 12 HB 312 are not subject to the unallocated reduction imposed by (a) of this section: 13 (1) that portion of the appropriation made to the Department of Administration 14 for Alaska longevity programs management that is allocated for Pioneers' Homes; 15 (2) those portions of the appropriation made to the Department of Corrections 16 for administration and operations that are allocated for the Anvil Mountain Correctional 17 Center, Combined Hiland Mountain Correctional Center, Cook Inlet Correctional Center, 18 Fairbanks Correctional Center, Ketchikan Correctional Center, Lemon Creek Correctional 19 Center, Matanuska-Susitna Correctional Center, Palmer Correctional Center, Sixth Avenue 20 Correctional Center, Spring Creek Correctional Center, Wildwood Correctional Center, Yukon- 21 Kuskokwim Correctional Center, and community jails; 22 (3) the appropriation made to the Department of Corrections for community 23 residential centers; 24 (4) the appropriation made to the Department of Corrections for out-of-state 25 contractual; 26 (5) the appropriation made to the Department of Corrections for the Point 27 MacKenzie rehabilitation program; 28 (6) the appropriation made to the Department of Education and Early 29 Development for the Mt. Edgecumbe Boarding School; 30 (7) those portions of the appropriation made to the Department of Health and 31 Social Services for juvenile justice that are allocated for the McLaughlin Youth Center, 01 Fairbanks Youth Facility, Nome Youth Facility, Johnson Youth Center, Bethel Youth Facility, 02 Matanuska-Susitna Youth Facility, and Ketchikan Regional Youth Facility; 03 (8) that portion of the appropriation made to the Department of Health and 04 Social Services for institutions and administration that is allocated for the Alaska Psychiatric 05 Institute; 06 (9) that portion of the appropriation made to the Department of Military and 07 Veterans' Affairs for the Alaska National Guard that is allocated for the Alaska Military Youth 08 Academy; 09 (10) the appropriation made to the University of Alaska. 10 (c) The amounts appropriated from the general fund for the fiscal year 2001 operating 11 expenses of the legislative branch as contained in the Conference Committee Substitute for 12 HB 312 and enacted into law are reduced by 1.125 percent. This reduction is an unallocated 13 reduction of the amount appropriated from the general fund to the legislative branch, and the 14 Legislative Council and the Legislative Budget and Audit Committee shall allocate the 15 reduction among appropriations to the legislative branch. 16 * Sec. 4. CONTINGENT EFFECT. (a) This Act does not take effect if the governor 17 exercises the line item veto or line item reduction power to veto or reduce a provision 18 contained in sec. 3 of this Act. 19 (b) It is the intent of the legislature that, if this Act is not enacted as passed by the 20 legislature, then this Act does not take effect.
