01 "An Act relating to reports and audits concerning health care facilities; and                                           
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 47.07.070 is amended by adding a new subsection to read:                                            
05  (g)  In determining a rate of payment to a health facility under this section, the                                    
06 department may consider audit and inspection results and reports relating to the                                        
07 facility.                                                                                                               
08    * Sec. 2.   AS 47.07.071 is amended to read:                                                                         
09  Sec. 47.07.071.  Reports by health facilities.  After [NOT LATER THAN 120                                           
10 DAYS AFTER] the end of each fiscal year of a health facility, the facility shall submit                                 
11 to the department a report on the facility's financial performance during the fiscal year.                             
12 The commissioner shall, by regulation, establish the date by which this financial                                       
13 report is due.                                                                                                         
14    * Sec. 3.  AS 47.07.074 is amended to read:                                                                          
01  Sec. 47.07.074.  Audits and inspections.  As a condition of obtaining payment                                         
02 under AS 47.07.070, a health facility shall allow                                                                       
03   (1)  the department and the commission reasonable access to the                                                      
04 financial records of medical assistance beneficiaries; and                                                              
05   (2)  audit and inspection of financial records by state and federal                                                
06 agencies [TO THE EXTENT REQUIRED BY FEDERAL LAW].                                                                       
07    * Sec. 4.  AS 47.07.074 is amended by adding a new subsection to read:                                               
08  (b)  The department may establish the scope and timing of audits under this                                           
09 chapter.  The department may provide that audits will be conducted less frequently                                      
10 than annually.                                                                                                          
11    * Sec. 5.  This Act takes effect immediately under AS 01.10.070(c).
