00 HOUSE BILL NO. 447 01 "An Act relating to prohibiting persons with convictions for crimes involving 02 domestic violence or stalking or who are respondents in domestic violence 03 protective orders from possessing deadly weapons when contacting the victim of 04 the offense or the petitioner or other person protected by the protective order; 05 and defining 'domestic violence or sexual assault shelter' for purposes of 06 misconduct involving weapons in the fifth degree." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 11.61.200(a) is amended by adding a new paragraph to read: 09  (13) having been convicted of a crime involving domestic violence or 10 stalking, knowingly possesses a deadly weapon while contacting the victim of the 11 crime involving domestic violence; in this paragraph, "contacting" includes 12  (A) following or appearing within the sight of the victim; 13  (B) approaching or confronting the victim in a public place or 14 on private property; 01  (C) appearing at the workplace or residence of the victim; or 02  (D) entering onto or remaining on property owned, leased, or 03 occupied by the victim. 04 * Sec. 2. AS 11.61.210(a) is amended by adding a new paragraph to read: 05  (9) under circumstances other than as provided in AS 11.61.200(a)(9) 06 while being the respondent in a protective order issued under AS 18.66.100, knowingly 07 possesses a deadly weapon while contacting the petitioner for the protective order or 08 other person the protective order is designed to protect; in this paragraph, "contacting" 09 includes 10  (A) following or appearing within the sight of the petitioner or 11 other person; 12  (B) approaching or confronting the petitioner or other person in 13 a public place or on private property; 14  (C) appearing at the workplace or residence of the petitioner or 15 other person; or 16  (D) entering onto or remaining on property owned, leased, or 17 occupied by the petitioner or other person. 18 * Sec. 3. AS 11.61.220 is amended by adding a new subsection to read: 19  (j) In this section, "domestic violence or sexual assault shelter" or "shelter" 20 means the portions of a building or other place housing a program that provides 21 residential or nonresidential services for victims of domestic violence or sexual assault.
