00 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 164 01 "An Act providing that employment as a legislator or with the National Education 02 Association is not credited service under the teachers' retirement system; 03 prohibiting membership in the teachers' retirement system for holders of limited 04 certificates; removing teachers holding limited certificates to teach Alaska Native 05 language or culture from membership in the teachers' retirement system; and 06 repealing a provision permitting members of the teachers' retirement system to 07 count unused sick leave credit as credited service." 08 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. AS 14.25.040(a) is amended to read: 10  (a) Unless a teacher or member has elected to participate in the optional 11 university retirement program under AS 14.40.661 - 14.40.799, a teacher or member 12 contracting for service with a participating employer is subject to this chapter.  13 However, beginning on the effective date of this Act, a limited certificate issued 14 under AS 14.20.025 does not entitle the holder to membership under this chapter. 01 * Sec. 2. AS 14.25.220(16) is amended to read: 02  (16) "employer" means a public school district, the Board of Regents 03 of the University of Alaska, the Department of Education, or [THE NATIONAL 04 EDUCATION ASSOCIATION OF ALASKA,] the Regional Resource Centers [, OR 05 THE STATE LEGISLATURE WITH RESPECT TO A STATE LEGISLATOR WHO 06 ELECTS MEMBERSHIP UNDER AS 14.25.040(b)]; 07 * Sec. 3. AS 14.25.040(b), 14.25.040(c), 14.25.045, 14.25.048, 14.25.115(a), 08 14.25.220(6)(B), 14.25.220(21)(D), 14.25.220(21)(F), and 14.25.220(40)(D) are repealed. 09 * Sec. 4. This Act applies to persons who first become members of the teachers' retirement 10 system on or after the effective date of this Act.
