00 CS FOR HOUSE BILL NO. 153(FIN) 01 "An Act relating to the eligibility of aliens for state public assistance and 02 medical assistance programs affected by federal welfare reform legislation; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 47.07.020 is amended by adding a new subsection to read: 06  (h) A person who meets the eligibility requirements of (a) or (b) of this 07 section, except that the person is a qualified alien as defined in 8 U.S.C. 1641, is 08 eligible for medical assistance unless the person is not eligible under the limited 09 eligibility provision of 8 U.S.C. 1613. 10 * Sec. 2. AS 47.25.430 is amended by adding a new subsection to read: 11  (f) Unless the person is not eligible under the limited eligibility provision of 12 8 U.S.C. 1613, a state payment under AS 47.25.430 - 47.25.615 shall be made to a 13 person who 14  (1) meets the requirements of state law; 01  (2) is a qualified alien as defined in 8 U.S.C. 1641; and 02  (3) otherwise meets the eligibility requirements of 42 U.S.C. 1381 - 03 1383. 04 * Sec. 3. AS 47.27.015, as enacted by sec. 7, ch. 107, SLA 1996, is amended by adding 05 a new subsection to read: 06  (f) A person who is an alien is not eligible for assistance under this chapter 07 unless the person is a qualified alien under 8 U.S.C. 1641 or an alien excepted under 08 8 U.S.C. 1612(b). However, a qualified alien may only be eligible for assistance under 09 this chapter if the person is not precluded by the limited eligibility provision of 8 10 U.S.C. 1613. 11 * Sec. 4. Sections 1 and 2 of this Act take effect immediately under AS 01.10.070(c). 12 * Sec. 5. Section 3 of this Act takes effect on the effective date of sec. 7, ch. 107, SLA 13 1996.
