00 CS FOR SENATE JOINT RESOLUTION NO. 4(STA) 01 Relating to an amendment to the Constitution of the United States setting out the 02 authority of the United States Congress, of state legislatures, and of local 03 governments to enact laws relating to limits on election campaign expenditures. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 WHEREAS, under Article V of the Constitution of the United States, amendments to 06 the Constitution of the United States may be proposed by the Congress of the United States 07 or, upon the application of the legislatures of two-thirds of the states, the Congress shall call 08 a constitutional convention for the purpose of proposing amendments; 09 BE IT RESOLVED by the Alaska State Legislature that the Congress of the United 10 States is requested to propose and submit to the states an amendment to the Constitution of 11 the United States that reads substantially as follows: 12 ARTICLE -- 13  Section 1. Congress shall have power to set reasonable limits on 14 expenditures made in support of or in opposition to the nomination or election 01 of any person to Federal office. 02  Section 2. Each State shall have power to set reasonable limits on 03 expenditures made in support of or in opposition to the nomination or election 04 of any person to State office. 05  Section 3. Each local government of general jurisdiction shall have 06 power to set reasonable limits on expenditures made in support of or in 07 opposition to the nomination or election of any person to office in that 08 government. No State shall have power to limit the power established by this 09 section. 10  Section 4. Congress shall have power to implement and enforce this 11 article by appropriate legislation. 12 and be it 13 FURTHER RESOLVED that, alternatively, the Alaska State Legislature makes 14 application and requests that the Congress of the United States call a convention for the sole 15 and exclusive purpose of proposing substantially the same amendment to the Constitution of 16 the United States; and be it 17 FURTHER RESOLVED that if the Congress proposes such an amendment to the 18 Constitution of the United States, this application and request for a constitutional convention 19 shall no longer be of any force or effect; and be it 20 FURTHER RESOLVED that this application and request shall not be of any force 21 or effect if the convention is not limited to the exclusive purpose specified by this resolution. 22 COPIES of this resolution shall be sent to the Honorable Bill Clinton, President of the 23 United States; to Sheila P. Burke, the Secretary of the U.S. Senate; to Robin Hewlett Carle, 24 the Clerk of the U.S. House of Representatives; and to the Honorable Ted Stevens and the 25 Honorable Frank Murkowski, U.S. Senators, and the Honorable Don Young, U.S. 26 Representative, members of the Alaska delegation in Congress.
