01 "An Act accepting transfer to the state of the Tongass National Forest land from                                        
02 the United States; and providing for an effective date."                                                                
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 38.95 is amended by adding a new section to read:                                                   
05 ARTICLE 7.  TONGASS NATIONAL FOREST LAND.                                                                               
06  Sec. 38.95.300.  TONGASS NATIONAL FOREST LAND ACCEPTED.  (a)                                                          
07 The state elects to receive all Tongass National Forest land made available to the state                                
08 by the United States under the Tongass Transfer and Transition Act or other federal                                     
09 law.                                                                                                                    
10  (b)  The state agrees that the                                                                                        
11   (1)  Tongass National Forest land received by the state under this                                                   
12 section is subject to all valid interests in and rights to the land that exist on the date                              
13 of the transfer;                                                                                                        
14   (2)  transition provisions and procedures for the transfer of the Tongass                                            
01 National Forest land to the state contained in the Tongass Transfer and Transition Act                                  
02 or other federal law apply to the transfer of land under this section; and                                              
03   (3)  rights and obligations of the United States under 43 U.S.C. 1601 -                                              
04 1629e (Alaska Native Claims Settlement Act) with respect to the land, rights in land,                                   
05 and use of land transferred under this section shall not be infringed by the state.                                     
06    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
