00 SENATE BILL NO. 78 01 "An Act related to the authority of certain beverage dispensary licensees to stock 02 alcoholic beverages in guest rooms and prohibiting certain room rentals for the 03 purpose of providing alcoholic beverages to a person under 21 years of age." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. FINDING AND PURPOSE. The legislature finds that international and 06 domestic travelers are accustomed to receiving hospitality services in their rooms for business 07 entertainment and personal enjoyment. The purpose of this Act is to enhance the 08 accommodations and services available to travelers visiting Alaska. 09 * Sec. 2. AS 04.11.090 is amended by adding a new subsection to read: 10  (g) A holder of a beverage dispensary license issued to a hotel, motel, resort, 11 or similar business that caters to the traveling public may stock alcoholic beverages 12 in guest rooms, for sale and consumption in the guest room only, if authorized by the 13 board. The board may not authorize the stocking of alcoholic beverages in guest 14 rooms unless the holder of the beverage dispensary license also has a minimum 01 number of rental rooms as required under AS 04.11.400(d)(1). Alcoholic beverages 02 stocked under this subsection shall be stocked by an employee who is 21 years of age 03 or older, may not be supplied or resupplied during hours that the sale of alcoholic 04 beverages is prohibited as provided under AS 04.16.010(a) and (d), and shall be stored 05 in a refrigerated unit using a key or combination lock system within the guest room. 06 A key lock system shall be designed to prevent the removal of the key unless the 07 refrigerated unit is locked. Except for the licensee, or an agent or employee of the 08 licensee, a key or combination enabling a person to obtain alcoholic beverages stocked 09 in a guest room may only be provided to a guest who occupies the room and who is 10 21 years of age or older. The board shall issue a permit to each licensee authorized 11 to stock alcoholic beverages under this subsection and may by regulation impose an 12 administrative fee for the cost of issuing the permit. 13 * Sec. 3. AS 04.16 is amended by adding a new section to read: 14  Sec. 04.16.055. ROOM RENTAL FOR PURPOSES OF CONSUMING 15 ALCOHOLIC BEVERAGES. A person may not rent a room in a hotel, motel, resort, 16 or similar business for the purpose of providing alcoholic beverages to a person under 17 the age of 21 years.
