00 SENATE BILL NO. 35                                                                                                      
01 "An Act relating to deposits to the budget reserve fund."                                                               
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 37.10 is amended by adding a new section to read:                                                    
04  Sec. 37.10.430.  DEPOSITS TO THE BUDGET RESERVE FUND.  Each year                                                      
05 the Department of Administration shall determine the amount appropriated from the                                       
06 budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska) that remains                                
07 unpaid.  The department shall also determine the amount of money in the general fund                                    
08 that was available for appropriation at the end of the preceding fiscal year.  Based                                    
09 upon these determinations, the department shall deposit into the budget reserve fund                                    
10 that amount of available general fund money required to be repaid under art. IX, sec.                                   
11 17(d), Constitution of the State of Alaska.  The deposit shall be made each year                                        
12 immediately after the annual financial report is filed with the governor under                                          
13 AS 37.05.210(1) for the preceding fiscal year.                                                                          
14    * Sec. 2.  AS 37.10.420(b) is repealed.
