01 "An Act restricting the transfer of state assets and the assets of state entities to                                    
02 certain organizations."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 44.68 is amended by adding a new section to read:                                                   
05 ARTICLE  6.  TRANSFERS OF STATE ASSETS TO OTHER ENTITIES.                                                               
06  Sec. 44.68.350.  RESTRICTIONS ON TRANSFER OF ASSETS TO CERTAIN                                                        
07 ORGANIZATIONS.  (a)  Notwithstanding other provisions of law, a state agency,                                           
08 state corporation, political subdivision of the state, or other state entity may not                                    
09 transfer an asset of the state, a state corporation, or a political subdivision of the state                            
10 to an organization unless the organization agrees in writing to use the asset for the                                   
11 benefit of the public on a nondiscriminatory basis and, with respect to the receipt and                                 
12 management of the asset, waives any sovereign immunity it may have.                                                     
13  (b) In this section,                                                                                                  
14   (1)  "asset" means real or personal property, including surplus property;                                            
01   (2)  "organization" means a Native council or other entity that performs                                             
02 services or is operated on a racially discriminatory basis.
