01 "An Act relating to application of the Public Employment Relations Act to                                               
02 municipalities and other political subdivisions."                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS  23.40 is amended by adding a new section to read:                                                  
05  Sec. 23.40.085.  APPLICATION TO POLITICAL SUBDIVISIONS.  (a)                                                          
06 Except as provided in (b) of this section, the provisions of AS 23.40.070 - 23.40.260                                   
07 do not apply to municipalities and other political subdivisions of the state.                                           
08  (b)  A municipality or other political subdivision that has                                                           
09   (1)  not elected or, after election, has rejected application of the                                                 
10 provisions of AS 23.40.070 - 23.40.260 may elect to become covered by these                                             
11 provisions by majority vote of the voters participating in the election;                                                
12   (2)  elected to be covered by the provisions of AS 23.40.070 - 23.40.260                                             
13 may subsequently reject coverage of these provisions by majority vote of the voters                                     
14 participating in the election.                                                                                          
01    * Sec. 2.  Section 4, ch. 113, SLA 1972, and sec. 11, ch. 1, SLA 1992, are repealed.                                 
02    * Sec. 3.  This Act does not terminate or modify the terms of a collective bargaining                                
03 agreement in effect on the effective date of this Act.
