00 HOUSE BILL NO. 141 01 "An Act relating to the appointment of members of the Board of Fisheries." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 16.05.221(c) is amended to read: 04  (c) Members of the [BOARD OF FISHERIES OR] Board of Game serve 05 staggered terms of three years and until a successor is appointed. An appointment to 06 fill a vacancy in the membership of the [BOARD OF FISHERIES OR] Board of Game 07 shall be made in the same manner as the original appointment and for the balance of 08 the unexpired term. 09 * Sec. 2. AS 16.05.221 is amended by adding a new subsection to read: 10  (d) Members of the Board of Fisheries serve staggered terms of three years 11 and until a successor is qualified to serve on the board. The terms of members of the 12 board begin on July 1. Notwithstanding AS 39.05.080(1), by April 1 of the calendar 13 year in which the term expires, the governor shall appoint a person to fill a vacancy 14 on the board due to expiration of the term of a member of the board and submit the 01 name of the person to the legislature for confirmation. If a vacancy arises on the 02 board other than by the expiration of a term, the governor shall, within 30 days after 03 the vacancy arises, appoint a person to serve the balance of the unexpired term and 04 submit the name of the person to the legislature for confirmation. A person appointed 05 to fill the balance of an unexpired term shall serve on the board from the date of 06 appointment until the earlier of the expiration of the term or the failure of the 07 legislature to confirm the person under AS 39.05.080. 08 * Sec. 3. TRANSITION. Notwithstanding AS 16.05.221(c) as that provision read on the 09 date when the current members of the Board of Fisheries were appointed, the expiration date 10 of the terms of the persons serving on the Board of Fisheries on the effective date of this Act 11 is extended from January 31 of the calendar year in which the term expires to June 30 of that 12 calendar year.
