00 SENATE JOINT RESOLUTION NO. 12 01 Proposing amendments to the Constitution of the State of Alaska relating to 02 subsistence use of fish and wildlife by residents and establishing an effective date 03 for that amendment. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. Article VIII, Constitution of the State of Alaska, is amended by adding a new 06 section to read: 07  SECTION 19. SUBSISTENCE USE OF FISH AND WILDLIFE. Subsistence 08 use is the priority beneficial use of fish and wildlife resources belonging to the State. 09 Consistent with the sustained yield principle, the legislature may grant a preference to 10 and among residents in the taking of fish and wildlife for subsistence use on the basis 11 of rural residency, community or area characteristics, geography, customary and 12 traditional use, direct dependence, local residence, or the availability of alternative 13 resources. 14 * Sec. 2. Article XV, Constitution of the State of Alaska, is amended by adding a new 01 section to read: 02  SECTION 29. EFFECTIVE DATE OF SUBSISTENCE AMENDMENT. 03 Section 19 of Article VIII, regarding subsistence use of fish and wildlife, takes effect 04 immediately upon certification of the election returns by the lieutenant governor. 05 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 06 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 07 State of Alaska, and the election laws of the state.
