01 "An Act relating to the method of calculating the weight of live marijuana plants                                       
02 for purposes of applying controlled substance laws and amending the definition                                          
03 of `marijuana'."                                                                                                        
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 11.71.080 is amended to read:                                                                       
06  Sec. 11.71.080.  AGGREGATE WEIGHT OF LIVE MARIJUANA PLANTS.                                                           
07 For purposes of calculating the aggregate weight of a live marijuana plant, the                                         
08 aggregate weight shall be the weight of the entire marijuana plant, excluding the root                               
09 wad and any growing attachments, at the time of harvest or seizure [WHEN                                               
10 REDUCED TO ITS COMMONLY USED FORM].                                                                                     
11    * Sec. 2.  AS 11.71.900(14) is amended to read:                                                                      
12   (14)  "marijuana" means the stalks, seeds, and leaves, buds, and flowers                                           
13 of the plant (genus) Cannabis, whether growing or not; it does not include the resin                                    
14 or oil extracted from any part of the plants, or any compound, manufacture, salt,                                       
01 derivative, mixture, or preparation from the resin or oil, including hashish, hashish oil,                              
02 and natural or synthetic tetrahydrocannabinol; it does not include [THE STALKS OF                                       
03 THE PLANT,] fiber produced from the stalks, oil or cake made from the seeds of the                                      
04 plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the                                
05 stalks, fiber, oil or cake, or the sterilized seed of the plant which is incapable of                                   
06 germination;
