01 "An Act allowing a school district to offset a reduction of five percent or more                                        
02 in elementary and secondary school instructional units that the district is eligible                                    
03 to receive under the foundation formula; and providing for an effective date."                                          
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 14.17.031(b) is amended to read:                                                                    
06  (b)  If the total elementary and secondary instructional units that a school                                          
07 district is eligible to receive under (a) of this section decrease by at least five but less                           
08 than 25 [10] percent [OR MORE] from one fiscal year to the next, the school district                                   
09 may use the last fiscal year before the reduction as a base fiscal year and offset its                                  
10 reduction according to the following schedule: (1) for the first fiscal year after the base                             
11 fiscal year, the school district is eligible to receive the total elementary and secondary                              
12 instructional units determined under (a)(1) of this section plus 75 percent of the                                      
13 difference in total elementary and secondary instructional units between the base fiscal                                
14 year and the first fiscal year after the base fiscal year; (2) for the second fiscal year                               
01 after the base fiscal year, the school district is eligible to receive the total elementary                             
02 and secondary instructional units determined under (a)(1) of this section plus 50                                       
03 percent of the difference in total elementary and secondary instructional units between                                 
04 the base fiscal year and the second fiscal year after the base fiscal year; (3) for the                                 
05 third fiscal year after the base fiscal year, the school district is eligible to receive the                            
06 total elementary and secondary instructional units determined under (a)(1) of this                                      
07 section plus 25 percent of the difference in total elementary and secondary instructional                               
08 units between the base fiscal year and the third fiscal year after the base fiscal year.                                
09 The schedule established in this subsection is available to a school district for the three                             
10 fiscal years following the base fiscal year only if the total elementary and secondary                                  
11 instructional units received by the school district under (a)(1) of this section for each                               
12 fiscal year are less than the total elementary and secondary instructional units received                               
13 by the school district in the base fiscal year.  This subsection does not apply to a                                    
14 decrease in total elementary and secondary instructional units resulting from a loss of                                 
15 enrollment that occurs as a result of a boundary change under AS 29.                                                    
16    * Sec. 2.  AS 14.17.031 is amended by adding new subsections to read:                                                
17  (c)  If the total elementary and secondary instructional units that a school                                          
18 district is eligible to receive under (a) of this section decrease by at least 25 percent                               
19 but less than 50 percent from one fiscal year to the next, the school district may use                                  
20 the last fiscal year before the reduction as a base fiscal year and offset its reduction                                
21 according to the following schedule:  (1)  for the first fiscal year after the base fiscal                              
22 year, the school district is eligible to receive the total elementary and secondary                                     
23 instructional units determined under (a)(1) of this section plus 67 percent of the                                      
24 difference in total elementary and secondary instructional units between the base fiscal                                
25 year and the first fiscal year after the base fiscal year; (2) for the second fiscal year                               
26 after the base fiscal year, the school district is eligible to receive the total elementary                             
27 and secondary instructional units determined under (a)(1) of this section plus 33                                       
28 percent of the difference in total elementary and secondary instructional units between                                 
29 the base fiscal year and the second fiscal year after the base fiscal year.  The schedule                               
30 established in this subsection is available to a school district for the two fiscal years                               
31 following the base fiscal year only if the total elementary and secondary instructional                                 
01 units received by the school district under (a)(1) of this section for each fiscal year are                             
02 less than the total elementary and secondary instructional units received by the school                                 
03 district in the base fiscal year.  This subsection does not apply to a decrease in total                                
04 elementary and secondary instructional units resulting from a loss of enrollment that                                   
05 occurs as a result of a boundary change under AS 29.                                                                    
06  (d)  If the total elementary and secondary instructional units that a school                                          
07 district is eligible to receive under (a) of this section decrease by 50 percent or more                                
08 from one fiscal year to the next, the school district may use the last fiscal year before                               
09 the reduction as a base fiscal year and offset its reduction.  For the first fiscal year                                
10 after the base fiscal year, the school district is eligible to receive the total elementary                             
11 and secondary instructional units determined under (a)(1) of this section plus 50                                       
12 percent of the difference in total elementary and secondary instructional units between                                 
13 the base fiscal year and the first fiscal year after the base fiscal year.  The schedule                                
14 established in this subsection is available to a school district for one fiscal year                                    
15 following the base fiscal year.  This subsection does not apply to a decrease in total                                  
16 elementary and secondary instructional units resulting from a loss of enrollment that                                   
17 occurs as a result of a boundary change under AS 29.                                                                    
18    * Sec. 3.  This Act takes effect July 1, 1994.
