00 SENATE BILL NO. 282 01 "An Act relating to matching funds for state grants for public water supply, 02 treatment, and distribution systems, public sewage collection, treatment, and 03 discharge facilities, solid waste processing or disposal facilities, and programs or 04 facilities for enhancing or protecting water quality; and providing for an effective 05 date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 46.03.030(b) is amended to read: 08  (b) The department may grant to a municipality, as funds are available, up to 09 50 percent of eligible costs [NOT FINANCED BY THE FEDERAL GOVERNMENT,] 10 for public water supply, treatment, and distribution systems and public sewage 11 collection, treatment, and discharge facilities for which construction has not 12 commenced on or before June 21, 1976. The eligible cost of a project or portions of 13 a project are determined by the federal agency granting the most monetary assistance. 14 On projects or portions of projects for which federal participation is not available, 01 eligible costs shall be determined by the department in accordance with (d) of this 02 section. Projects shall be constructed in accordance with plans and specifications 03 approved by the department. 04 * Sec. 2. AS 46.03.030(e) is amended to read: 05  (e) The department may grant to a municipality not more than 50 percent of 06 the eligible costs [THAT ARE NOT PAID FOR BY THE FEDERAL 07 GOVERNMENT] for solid waste processing or disposal facilities constructed after 08 July 1, 1980. However, the department may grant a municipality up to 60 percent of 09 the eligible costs [NOT PAID FOR BY THE FEDERAL GOVERNMENT] for a solid 10 waste processing or disposal facility constructed after July 1, 1980, if the facility is 11 used for resource recovery. The eligible costs of a solid waste processing or disposal 12 facility are determined by the federal agency granting the most monetary assistance for 13 construction of the facility. For a solid waste processing or disposal facility for which 14 federal money is not available, the department shall determine the eligible costs under 15 (d) of this section. A municipality shall construct solid waste processing or disposal 16 facilities financed by grants under this section according to plans and specifications 17 approved by the department. 18 * Sec. 3. AS 46.03.030(f) is amended to read: 19  (f) The department may make a grant to a municipality for the eligible costs 20 of programs and facilities for enhancing or protecting the water quality of streams, 21 lakes, waterways, and other bodies of water if the costs are incurred after July 1, 1986. 22 The grant may not exceed 50 percent of the eligible costs unless the department finds 23 that the program or facility is needed to avert an immediate hazard to health, in which 24 case the grant may be up to 100 percent of the eligible costs. Eligible costs [ARE 25 THOSE NOT FINANCED BY THE FEDERAL GOVERNMENT AND] include costs 26 of testing, research, education, enforcement, and clean-up programs for the purpose of 27 discovering and solving existing or potential water pollution problems. A grant may 28 be made under this subsection only for a water enhancement program approved by the 29 department. 30 * Sec. 4. AS 46.03.030 is amended by adding a new subsection to read: 31  (g) A municipality may use funds from the federal government to provide 01 matching money for a state grant under this section. 02 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
