00 SENATE BILL NO. 257 01 "An Act relating to legislative per diem; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.10.130(c) is amended to read: 04  (c) The Alaska Legislative Council shall adopt a policy regarding 05 reimbursement for moving expenses applicable to all legislators [AND AN 06 APPLICABLE PER DIEM ALLOWANCE POLICY]. The policy must set conditions 07 for the reimbursement for moving expenses [AND PAYMENT OF PER DIEM] and 08 prescribe the amounts of reimbursement adapted to the special needs of the legislative 09 branch as determined by the council. 10 * Sec. 2. AS 24.10.130 is amended by adding a new subsection to read: 11  (d) The per diem allowance to which a legislator or legislative employee is 12 entitled shall be a percentage of the federal per diem allowance for that location. The 13 Alaska Legislative Council shall adopt a policy to establish when a legislator or 14 legislative employee is entitled to per diem and setting the percentage of the federal 01 per diem rate that applies under this subsection. The percentage may take effect only 02 if it is ratified by each house of the legislature within the 30 legislative days 03 immediately following adoption of the percentage by the council. 04 * Sec. 3. Notwithstanding AS 24.10.130(d), enacted by sec. 2 of this Act, until the Alaska 05 Legislative Council acts in accordance with AS 24.10.130(d) to set the percentage of the 06 federal per diem rate that applies, the percentage rate shall be 60 percent. 07 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
