00 SENATE BILL NO. 28                                                                                                      
01 "An Act relating to the Yakataga area plan; and providing for an effective                                              
02 date."                                                                                                                  
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  Section 4(c), ch. 143, SLA 1990, is amended to read:                                                   
05  (c)  The area plan shall be completed by July 1, 1995 [1993], and shall be                                          
06 delivered to the chairs of the Resource Committees of the legislature.  The                                             
07 commissioner may include with the area plan recommendations for the restriction or                                      
08 expansion in the boundaries of the Yakataga State Game Refuge and for legislation                                       
09 defining a part of the area as a state park, state forest, state game refuge, state critical                            
10 habitat area, or other special designation.                                                                             
11    * Sec. 2.  Section 4(d), ch. 143, SLA 1990, is amended to read:                                                      
12  (d)  Except as provided in this subsection and (e) of this section and subject to                                     
13 valid existing rights, the commissioner of natural resources may not conduct timber or                                  
14 timber-related construction activity, including road construction, timber sales and                                     
01 commercial timber harvests in the Yakataga area, the area between Icy Bay and Cape                                      
02 Suckling, until July 1, 1995 [1993].  The commissioner may maintain existing timber                                   
03 harvest facilities.  This section does not diminish the right of a private property owner                               
04 to have access or develop its land or resources or the authority of an agency to grant                                  
05 approval for access or development.                                                                                     
06    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
