00 CS FOR HOUSE BILL NO. 393(CRA) 01 "An Act relating to the unincorporated community capital project matching grant 02 program; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 37.06.010(g) is amended to read: 05  (g) For purposes of this section, in calculating the population of a borough the 06 population of each city in the borough and the population of each unincorporated 07 community in the borough that is eligible to participate in the capital project 08 matching grant program under AS 37.06.020 is excluded. The determination of 09 population for each city shall be based upon data used by the Department of 10 Community and Regional Affairs under AS 29.60.020. The determination of 11 population of each unincorporated community shall be based on the latest figures 12 of the United States Bureau of the Census or other population data that is 13 reliable. 14 * Sec. 2. AS 37.06.020(b) is amended to read: 01  (b) The unincorporated community capital project matching grant fund is 02 established in the department and consists of appropriations to the fund. Appropriations 03 to the fund do not lapse except as provided in (h) of this section. The money in the 04 fund is held by the department in custody under this subsection for each 05 unincorporated community eligible for an allocation under this subsection. The 06 department shall establish an individual grant account within the fund for each eligible 07 unincorporated community [THAT WAS ENTITLED TO RECEIVE STATE AID 08 UNDER AS 29.60.140 DURING THE PRECEDING FISCAL YEAR]. As provided 09 in this subsection, each fiscal year the department shall allocate, to the individual grant 10 accounts, appropriations to the fund. An unincorporated community is eligible for an 11 allocation in a fiscal year if the community (1) was eligible to receive state aid under 12 AS 29.60.140 during the preceding fiscal year; or (2) is located in a borough, other 13 than a unified municipality, and was a place in which 25 or more individuals 14 resided as a social unit during the preceding fiscal year. The department shall 15 credit interest earned on money in an individual grant account to that account. Except 16 as provided in (c) of this section, the amount allocated under this subsection to an 17 individual grant account in a fiscal year is determined by dividing the total amount 18 appropriated to the fund during that fiscal year by the number of unincorporated 19 communities eligible for an allocation during that fiscal year. 20 * Sec. 3. AS 37.06.020(e) is amended to read: 21  (e) By October 1 of each fiscal year, the incorporated nonprofit entity or 22 Native village council designated by the department under (d) of this section shall 23 submit to the governor a prioritized list of capital projects and estimated costs to be 24 financed with money from the community's individual grant account established under 25 (b) of this section. The list must include the amount and source of the local share 26 required by AS 37.06.030. If the community is located in a borough, the list is 27 subject to approval of the assembly and must be accompanied by written evidence 28 of that approval. The governor shall include in the capital improvements program 29 presented to the legislature under AS 37.07.060 the projects submitted by designated 30 entities under this subsection that the governor recommends for funding. If, in the 31 capital improvements program, the governor includes projects in other than the priority 01 order submitted by a designated entity, the governor shall provide the legislature with 02 a written statement of the reasons for that action. 03 * Sec. 4. AS 37.06.030(c) is amended to read: 04  (c) For purposes of (a) of this section, in calculating the population of a 05 borough the population of each city in the borough is excluded and the population 06 of each unincorporated community that qualified for an allocation under 07 AS 37.06.020(b) for the previous fiscal year is excluded. The determination of 08 population for a city shall be based upon data used by the Department of Community 09 and Regional Affairs under AS 29.20.060. The determination of population of each 10 unincorporated community shall be based on the latest figures of the United 11 States Bureau of the Census or other population data that is reliable. 12 * Sec. 5. This Act takes effect July 1, 1994.
