01 "An Act relating to solid waste management."                                                                            
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 46.03.030(e) is amended to read:                                                                    
04  (e)  The department may grant to a municipality not more than 50 percent of                                           
05 the eligible costs that are not paid for by the federal government for solid waste                                      
06 processing or disposal facilities constructed after July 1, 1980.  However, the                                         
07 department may grant a municipality up to 60 percent of the eligible costs not paid for                                 
08 by the federal government for a solid waste processing or disposal facility constructed                                 
09 after July 1, 1980, if the facility is used for resource recovery.  The eligible costs of                               
10 a solid waste processing or disposal facility are determined by the federal agency                                      
11 granting the most monetary assistance for construction of the facility.  For a solid                                    
12 waste processing or disposal facility for which federal money is not available, the                                     
13 department shall determine the eligible costs under (d) of this section.  A municipality                                
14 shall construct solid waste processing or disposal facilities financed by grants under                                  
01 this section according to plans and specifications approved by the department.  The                                    
02 department may not award a grant under this subsection for a facility that is not                                       
03 consistent with the state or municipal solid waste management plan required                                             
04 under AS 46.06.015.                                                                                                    
05    * Sec. 2.  AS 46.06 is amended by adding new sections to read:                                                       
06  Sec. 46.06.015.  SOLID WASTE MANAGEMENT PLANNING.  (a)  The                                                           
07 department shall develop and maintain a comprehensive statewide solid waste                                             
08 management plan to achieve the most economically feasible, cost-effective, and                                          
09 environmentally safe storage, collection, transport, separation, processing, recycling,                                 
10 reduction, and disposal of solid waste in the state in a manner that will protect the                                   
11 public health, safety, and welfare, enhance the environment, and recover resources that                                 
12 have the potential for further usefulness.  The department shall revise the plan every                                  
13 three years.                                                                                                            
14  (b)  The department shall annually report to the legislature its recommendations                                      
15 for legislation, funding mechanisms, and appropriations that are necessary to meet the                                  
16 goals contained in the solid waste management plan developed under (a) of this                                          
17 section.                                                                                                                
18  (c)  A municipality that has the power to manage solid waste shall develop and                                        
19 implement a solid waste management plan for the municipality that is consistent with                                    
20 the solid waste management plan developed under (a) of this section.                                                    
21  Sec. 46.06.017.  SOLID WASTE PERMITS.  The department shall implement                                                 
22 a permit system governing the establishment and operation of solid waste management                                     
23 facilities.  The permit system must include a provision that prohibits a permit from                                    
24 being granted for a facility within a municipality without the approval of the governing                                
25 body of the municipality.                                                                                               
26    * Sec. 3.  AS 46.06.041(d) is amended to read:                                                                       
27  (d)  The department shall establish guidelines for the preparation of plans                                           
28 funded under this section to achieve the practices and priorities established under                                     
29 AS 46.06.021.  A plan funded under this section must be consistent with the state                                      
30 solid waste management plan developed under AS 46.06.015(a).
