01 "An Act relating to reimbursable service agreements and other agreements                                                
02 between state agencies for the purchase of services."                                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 37.07.080(e) is amended to read:                                                                    
05  (e)  Transfers or changes between objects of expenditures or between                                                  
06 allocations may be made by the head of an [A STATE] agency upon approval of the                                       
07 office.  Transfers may not be made between appropriations, including transfers made                                    
08 through the use of a reimbursable service agreement or other agreement, except                                         
09 as provided in an act making the transfers between appropriations.  However, a                                         
10 reimbursable service agreement or other agreement may be used to finance the                                            
11 provision of a service if                                                                                               
12   (1)  the agency that requires the service has, by law, the authority                                                 
13 to obtain or provide the service and has an appropriation that may be used for                                          
14 that purpose; and                                                                                                       
01   (2)  the agency that provides the service bills the agency                                                           
02 administering the available funds based on                                                                              
03   (A)  the actual cost to provide the service; or                                                                     
04   (B)  a cost allocation method approved by the office.
