01 "An Act relating to criminal justice information about persons who operate or                                           
02 work in certain facilities licensed by the Department of Health and Social                                              
03 Services."                                                                                                              
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 12.62.035 is amended by adding a new subsection to read:                                            
06  (g)  The Department of Health and Social Services shall request and receive                                           
07 records under (a) of this section for the administrator of a facility seeking initial or                                
08 renewal licensure as a                                                                                                  
09   (1)  group home, institution, maternity home, or other residential child                                             
10 care facility, as those terms are defined in AS 47.35 and regulations adopted under                                     
11 AS 47.35;                                                                                                               
12   (2)  nursery, child care center, family child care home, or other                                                    
13 nonresidential child care facility, as those terms are defined in AS 47.35 and                                          
14 regulations adopted under AS 47.35.                                                                                     
01    * Sec. 2.  AS 47.35.020 is amended by adding a new subsection to read:                                               
02  (b)  The department may not license a person to maintain or conduct a facility                                        
03 if the person is under indictment or has been convicted of a felony within the last five                                
04 years.                                                                                                                  
05    * Sec. 3.  AS 47.35.040 is amended by adding a new subsection to read:                                               
06  (f)  At the time of issuance or renewal of a license under this section, the                                          
07 department shall notify the administrator of the facility that the administrator may                                    
08 request crime information under AS 12.62.035(a) for a person who holds or applies for                                   
09 a position in which the person has or would have supervisory or disciplinary power                                      
10 over a minor or dependent adult.                                                                                        
11    * Sec. 4.  AS 12.62.035(g), enacted by sec. 1 of this Act, applies to licenses that are issued                       
12 or renewed on or after the effective date of this Act.
